BOC-3 Processing Agent
All FMCSA-regulated motor carriers, brokers, and freight forwarders are required to have a BOC-3 filing on record with the FMCSA before operating authority can be issued.
What is a BOC-3 Processing Agent?
A BOC-3 process agent, commonly called an FMCSA agent, is a designated representative appointed in every state where your company conducts business operations.
A process agent is an individual or registered business entity authorized to receive legal documents on behalf of your company. This agent must maintain a physical address in each state where your company is authorized to operate and must be able to accept mailed correspondence.
Once appointed, the process agent has the legal authority to accept and forward service of process and other official legal notices for your company within the designated state or states. Service of process refers to the formal delivery of legal documents, such as a summons or complaint, informing a party that legal action has been filed and explaining the required response.
Who is required to have a BOC-3?
All motor carriers, brokers, and freight forwarders regulated by the FMCSA are required to have a BOC-3 form filed with the FMCSA before operating authority can be granted. In addition, if an MC or FF number has been revoked and reinstatement is needed, filing a BOC-3 is required to restore operating authority.
